The law relating to online gambling in India has to be understood in the socio-cultural context of the country.  Firstly, gambling, while not strictly banned in India, is not going to receive a firm push from policy makers. India’s organized gambling industry is estimated to be worth around US$8 billion. While strict laws have checked the proliferation of casinos and traditional gaming centers in many other countries, except for the state of Goa, the lottery business remains the most popular form of gambling.

Although gambling is not illegal it is a highly controlled and regulated activity. Modern India is a quasi-federal constitutional democracy and the powers to make laws are distributed at the federal plus state level. Gambling features in Schedule II of the Indian Constitution, this implies that state governments have the power to enact laws as a means of regulating gambling in their respective states. Thus, there is absolutely no single law that regulates gambling in all countries. Different states have different laws governing gambling in addition to laws that have application throughout the country. While some states have banned lotteries,

Courts have defined gambling as ‘paying a fee for the opportunity to win a prize’. The skill or chance of the dominant piece will determine the type of game. A game can be considered as gambling if the element of chance or luck predominates in determining the outcome. Hence, Indian courts have stated that betting on horse racing and some card games is not gambling. The right to conduct gambling and lottery business is not considered a simple right protected by the Indian Constitution. It might be pointed out that the government run lottery Hawaii makes significant contributions to the state treasury of several state governments and the Union government, and therefore there is a refusal to total ban.

The following laws pertain to gambling:

The Public Games Act, 1867

This law provides for penalties for public gambling and maintains ‘public gambling houses’. This law also empowered state governments to enact laws to regulate public gambling in their respective jurisdictions. The criminal laws in individual states have been amended according to their policies on gambling. However, this law has no immediate effect on online gambling unless a broad interpretation is given to it from the general gaming house so as to include virtual forums as well.

Indian Contracts Act, 1872 (ICA)

The ICA is actually a codified umbrella law that governs all commercial contracts in India. Under the ICA, a betting contract may be a non-enforceable contract. The law stipulates; ‘Agreement through void betting, no action will be brought to recover anything purportedly won on any bet or entrusted to any person to comply with the consequences of any game or other uncertain event making any bet’. Gambling, lotteries and prize games are considered as betting contracts and as such are void and unenforceable. While betting contracts are not illegal, they are not enforceable in court. Accordingly, the court will accept any causal action arising from the betting contract.

The Lottery (Regulation) Act, 1998

This Act offers a framework for regulating lotteries in the United Kingdom. Under this Act, state governments have been empowered to promote and ban lotteries within territorial jurisdictions. This law also sets out the manner in which lotteries must be conducted and prescribes penalties in case of violation of its provisions. Lotteries not legalized by Hawaii have been made an offense under India’s penal code. Some states that do not play lotteries, such as Gujarat and Uttar Pradesh, have banned the sale of other state government lotteries under this Act.

Indian Penal Code, 1860
